Welcome to PuzzlePlay! These Terms of Service ("Terms") govern your access to and use of our puzzle games, website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

1. Acceptance of Terms

By creating an account, downloading our applications, or using any part of our Services, you confirm that you are at least 13 years old and agree to these Terms. If you are between 13 and 18 years old, you represent that you have obtained parental or guardian consent to use our Services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using our Services.

5. Intellectual Property

All content, features, and functionality on our Services, including but not limited to puzzles, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of PuzzlePlay or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written permission.

6. User-Generated Content

If our Services allow you to submit, post, or display content (such as custom puzzles, comments, or feedback), you retain ownership of your content. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with our Services.

You represent and warrant that you own or have the necessary rights to submit the content and that it does not infringe any third-party rights or violate any laws.

7. In-App Purchases and Subscriptions

Our Services may offer premium features, additional puzzle packs, or subscription services for purchase. By making a purchase, you agree to:

• Pay all applicable fees and taxes
• Provide accurate payment information
• Be responsible for any charges incurred through your account

All purchases are final and non-refundable, except as required by law. Subscription fees will be charged automatically at the beginning of each subscription period until you cancel. You can cancel your subscription at any time through your account settings or app store.

8. Third-Party Services

Our Services may contain links to third-party websites or integrate with third-party services (such as social media platforms). These third-party services are not under our control, and we are not responsible for their content, privacy policies, or practices. Your use of third-party services is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PuzzlePlay and its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use our Services.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us, if any, during the six (6) months immediately preceding the date of the claim.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

11. Indemnification

You agree to indemnify, defend, and hold harmless PuzzlePlay and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco, California.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and PuzzlePlay regarding your use of our Services and supersede all prior agreements and understandings.
